THIS ARBITRATION SHALL BE HELD IN THE ATLANTA, GEORGIA AREA IN ACCORDANCE WITH THE COMMERCIAL RULES OF THE AMERICAN ARBITRATION ASSOCIATION, AND JUDGMENT ON THE ARBITRATION AWARD MAY BE ENTERED IN ANY COURT HAVING JURISDICTION.

YOU AND PHOENIX SYSTEMS FURTHER AGREE THAT ANY SUCH ARBITRATION WILL BE CONDUCTED ON AN INDIVIDUAL BASIS AND NOT AS A CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. YOU EXPRESSLY WAIVE YOUR RIGHT TO PARTICIPATE IN ANY CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION OR TO SEEK RELIEF ON A CLASS-WIDE BASIS.

YOU AND PHOENIX SYSTEMS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. YOU AND PHOENIX SYSTEMS THUS THE RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN A CLASS ACTION.

YOU MAY OPT-OUT OF THIS ARBITRATION AGREEMENT BY NOTIFYING PHOENIX SYSTEMS IN WRITING WITHIN 30 DAYS OF YOUR FIRST USE OF THE SITE OR THE DATE YOU AGREED TO THESE TERMS OF USE, WHICHEVER IS LATER.
